Terms of Use

1. Introduction

By accessing or using Zibble's Services, you agree to be bound by this Terms of Use Agreement (the “Terms” or “Agreement”), including our Privacy Policy, Community Guidelines, and Safety Tips. Please read this Agreement carefully before you create an account.

Dispute Resolution: Please carefully review the Dispute Resolution provisions in Section 14 below. These govern how disputes will be addressed between you and Zibble, including binding arbitration and class action waivers where permitted by law.

Welcome to Zibble. These Terms apply between you and Zibble (“we,” “us,” or “Company”). By accessing or using our Services on Zibble.com (the “Website”), the Zibble mobile application (the “App”), or any other platforms we may offer (collectively, the “Service” or “Services”), you agree to and are bound by this Agreement.

We may update these Terms from time to time. Notice of material changes will be posted on this page with an updated effective date. Your continued use of our Services after the effective date constitutes your consent to any changes.

2. Account Eligibility; Your Responsibilities

2a. Eligibility

You are not authorized to create an account or use the Services unless all of the following are true, and by using our Services, you represent and warrant that:

• You are an individual at least 18 years old;
• You are legally qualified to enter a binding contract with Zibble;
• You are not prohibited by law from using our Services;
• You have not committed, been convicted of, or pled no contest to any crime involving violence, the threat of violence, or sexual misconduct;
• You are not required to register as a sex offender with any state, federal, or local sex offender registry;
• You do not have any other active accounts on our Services; and
• You have not previously been removed from our Services unless you have our express written permission to create a new account.

2b. Your Responsibilities

You agree to:

• Comply with these Terms and all applicable laws;
• Use the latest version of the Website and/or App;
• Treat other users in a courteous and respectful manner;
• Review and comply with our Community Guidelines and Safety Tips; and
• Take reasonable measures to protect the security of your account and login information.

2c. Prohibited Conduct

You agree that you will not:

• Misrepresent your identity, age, or affiliations with any person or entity;
• Use the Services in a way that damages the Services or prevents their use by other users;
• Harass, bully, stalk, intimidate, assault, defame, harm, or otherwise mistreat any person;
• Post or share Prohibited Content (see Section 2d);
• Solicit passwords, personal identifying information, or money from other users;
• Use another user's account or share your account with another person;
• Use our Services in relation to fraud, a pyramid scheme, or other similar practice;
• Use any robot, crawler, or automated device to access, retrieve, or data mine our Services;
• Use or develop third-party applications or AI systems that interact with our Services without our written consent;
• Attempt to reverse engineer, decompile, or disassemble any portion of our Services; or
• Create a new account after we suspend or terminate your account, unless you receive our express permission.

2d. Prohibited Content

Zibble prohibits uploading or sharing content that:

• Could reasonably be deemed offensive, harassing, or alarming to any other person;
• Is obscene, pornographic, violent, or contains nudity;
• Is abusive, insulting, threatening, discriminatory, or promotes racism, sexism, hatred, or bigotry;
• Is illegal or encourages or facilitates any illegal activity;
• Encourages self-harm, eating disorders, dangerous challenges, or harmful misinformation;
• Is defamatory, libelous, or untrue;
• Relates to commercial activities, sex work, or solicitation for services;
• Infringes upon any third party's intellectual property or privacy rights;
• Includes the image or likeness of another person without that person's consent; or
• May harm the reputation of Zibble or its affiliates.

3. Content

While using our Services, you may have access to: (i) content that you upload or provide (“Your Content”); (ii) content that other users provide (“Member Content”); and (iii) content that Zibble provides (“Our Content”).

Zibble uses artificial intelligence and machine learning systems (“AI Technology”) as a core part of the Services, including AI agents that interact on your behalf during the ice-breaking phase. You are solely responsible for any content generated by such AI Technology that you create, upload, or share, including the instructions and personality parameters you provide to your agents.

3a. Your Content

You are responsible for Your Content. Don't share anything that you wouldn't want others to see, that would violate this Agreement, or that may expose you or us to legal liability. You represent and warrant that the information you provide is accurate and that you will update your account information as necessary.

You may not display personal contact, banking, or payment information on your profile. If you choose to reveal any personal information to other users, you do so at your own risk.

We may monitor, review, or remove Your Content at any time at our sole discretion. We may analyze Your Content, including agent interactions and messages, to monitor, develop, personalize, and improve our Services in accordance with applicable law and our Privacy Policy.

3b. Member Content

Member Content belongs to the user who posted it. You may only use Member Content to the extent consistent with our Services' purpose of allowing you to communicate with and meet others. You may not copy Member Content for commercial purposes, to spam, to harass, or to make unlawful threats.

3c. Our Content

All other content on our Services is owned, controlled, or licensed by Zibble and protected by copyright, trademark, and other intellectual property laws. We grant you a limited license to access and use Our Content as provided under Section 6.

4. AI Agents and Automated Interactions

Zibble's core feature is AI agents that converse on your behalf during the ice-breaking phase. By using this feature, you acknowledge and agree that:

• Your agents will interact with other users' agents using profile context and personality parameters you provide;
• Agent-to-agent conversations are processed by our AI systems and may be summarized for you before you choose to connect with a match;
• You remain in control — no human-to-human connection occurs without your explicit acceptance of a match;
• You are responsible for the instructions, prompts, and personality parameters you set for your agents, and for reviewing agent interaction summaries before engaging with matches;
• AI-generated content may not always be accurate, and you should use your own judgment when deciding whether to connect with another user.

5. Inappropriate Content and Misconduct; Reporting

Zibble does not tolerate inappropriate content or behavior on our Services. We encourage you to report any inappropriate Member Content or misconduct by other users through the in-app reporting tools or by contacting support.

We use a combination of automated tools and human reviewers to enforce our content rules. Violations may result in consequences ranging from a warning to permanent account termination. Manifestly unfounded reports may result in enforcement actions against the reporter.

6. Privacy

For information about how Zibble collects, uses, and shares your personal data, please read our Privacy Policy and Data Safety documents. By using our Services, you agree that we may use your personal data in accordance with our Privacy Policy.

7. Rights You Are Granted by Zibble

For as long as you comply with these Terms, Zibble grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable license to access and use our Services for purposes as intended by Zibble and permitted by these Terms. This license is automatically revoked if you fail to comply with these Terms.

8. Rights You Grant Zibble

By creating an account, you grant Zibble a worldwide, perpetual, transferable, sub-licensable, royalty-free right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, and otherwise make available Your Content as necessary to operate and improve the Services, including training and refining our AI models using anonymized interaction data as described in our Privacy Policy.

You acknowledge that Zibble's Services may learn and improve based on information received and generated, including Your Content, and cannot thereafter “unlearn” such improvements. Zibble's license to Your Content is subject to your rights under applicable data protection laws.

9. Purchases and Subscriptions

Zibble may offer products and services for purchase, including premium features and subscriptions. If you purchase a subscription, it will automatically renew until you cancel, in accordance with the terms disclosed at the time of purchase.

Purchases made through Apple ID, Google Play, or other external services must be managed through those respective accounts. Generally, all purchases are final and non-refundable, except where required by applicable law.

Canceling a subscription does not remove your profile from our Services. To fully terminate your account, you must delete your account as set forth in Section 10.

10. Account Termination

You can delete your account at any time through the app settings. You will need to cancel any external subscription purchases separately through your app store account to avoid additional billing.

Zibble reserves the right to suspend, terminate, or ban your account without a refund if we believe you have violated these Terms or misused our Services. If your account is terminated, your information will be maintained and deleted in accordance with our Privacy Policy.

11. No Background or Identity Verification Checks

Zibble does not conduct criminal background or identity verification checks on its users. Zibble makes no representations or warranties as to the conduct, identity, health, intentions, legitimacy, or veracity of users.

You are solely responsible for your interactions with other users, both on and off the Service. Always use your best judgment and take appropriate safety precautions when communicating with or meeting new people. Review our Safety Tips before meeting anyone in person.

12. Disclaimer

Zibble provides our Services on an “as is” and “as available” basis. To the extent permitted by applicable law, we grant no warranties of any kind with respect to our Services. Zibble does not represent or warrant that our Services will be uninterrupted, secure, or error free, or that any content or information you obtain will be accurate or appropriate for your purposes. Zibble makes no guarantees as to the number of active users, users' ability or desire to communicate with or meet you, or the ultimate compatibility with users you meet through the Services.

13. Digital Millennium Copyright Act

If you believe any content on our Services infringes your intellectual property rights, please submit a notification including: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the infringing material; (4) your contact information; (5) a statement of good faith belief; and (6) a statement of accuracy under penalty of perjury.

14. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Zibble, its affiliates, employees, licensors, or service providers be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Services. To the fullest extent permitted by applicable law, Zibble's aggregate liability to you for all claims relating to the Services shall not exceed the greater of (a) $100 USD or (b) the amount paid by you to Zibble for the Services during the twenty-four (24) month period preceding the date you first file a legal proceeding against Zibble.

15. Dispute Resolution

If you are dissatisfied with our Services, please contact us first at zibble.dating@gmail.com so we can try to resolve your concerns informally.

To the fullest extent allowable by law, you and Zibble each waive the right to a jury trial and the right to litigate disputes in court in favor of individual arbitration, except for disputes that may be heard in small claims court. You and Zibble each waive the right to file or participate in a class action.

Any dispute not resolved informally within 60 days shall be resolved through binding individual arbitration, except where prohibited by applicable law. Users residing in the EU, EEA, UK, or Switzerland are not subject to the arbitration provisions where prohibited by law.

16. Governing Law

These Terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict of laws rules, except where prohibited by applicable law. For users in the EU and EEA, mandatory consumer protection laws in your country of residence may apply.

17. Indemnity

You agree, to the extent permitted under applicable law, to indemnify, defend, and hold harmless Zibble and its affiliates from any claims, damages, losses, and expenses arising from your access to or use of our Services, Your Content, your conduct toward other users, or your breach of this Agreement.

18. Entire Agreement

These Terms, together with the Privacy Policy, Community Guidelines, and Safety Tips, contain the entire agreement between you and Zibble regarding the use of our Services. If any provision is held invalid or unenforceable, the remainder shall continue in full force. Your Zibble account is non-transferable and all rights to your account terminate upon your death, unless otherwise provided by law.
